IBM only ships Open Source software with that are screened for patents.

IBM does not distribute the whole linux kernel because IBM has only
screened part of the kernel for patents and will not risk being sued for
patent infringement done in other parts of the kernel.

This is also the reason why IBM only submits patches to the Linux kernel.
Before submission the patches are screened for any patents. When IBM wants
to ship a system with Linux they work with distributors (Such as SuSE and
RedHat). The distributors are then liable for any patent infringements.

It is also the reason why IBM does not distribute embedded systems that
has Linux preinstalled.
